Wellgo sues Tern Bicycles, MKS and New York retailer over patent dispute

NEW YORK (BRAIN) — Taiwan-based Wellgo Pedal Corp. is suing Tern Bicycles, Mikashima Industrial, and a New York City retailer over alleged patent infringment involving a quick release pedal.

Wellgo filed suit last Thursday in the U.S. District Court for the Southern District of New York. It claims that the MKS EZY and EZY Superior pedals infringe on a U.S. patent that Wellgo was granted in March 2014 for "A quick release device for a pedal."

Tern spec'd the MKS pedal on its Verge P20 bike, which is sold by the retailer named in the suit, NYCEWheels, a Manhattan store that specializes in folding bikes and e-bikes. NYCEWheels also stocks the pedals individually, selling them in its store and online.

The suit also leaves the door open for suing other distributors or agents involved in the MKS pedal's distribution, by suing 10 "Doe Defendants."

Wellgo is asking the court to order the defendants stop selling the pedals, recall them from commerce, and pay damages and legal costs.

The court issued an electronic summons to MKS, Tern and NYCEWheels on Friday and the case has been assigned to a judge. The defendants have not responded to the complaint.
