Wellgo withdraws patent suit over pedals after naming wrong company

NEW YORK (BRAIN) — Taiwan-based Wellgo Pedal Corp. is terminating its recent patent infringement suit against Tern Bicycles, Mikashima Industrial, and a New York City retailer over a quick release pedal.

John Chen, Wellgo's president, said the company was withdrawing its suit immediately due to a misunderstanding with its U.S. lawyers.

"Please note that Wellgo is immediately withdrawing the suit against Tern, MKS, NYCEWheels and the named defendants," Chen said.

The original suit, filed last Thursday in the U.S. District Court for the Southern District of New York, claimed that MKS had infringed on a quick-release device patented by Wellgo. However, Chen, in an email sent to BRAIN, said lawyers erroneously named MKS as the manufacturer when, in fact, it is another company.

The suit had also named Tern for spec'ing the pedal on its Verge P20 bike as well as NYCEWheels, a Manhattan store that specializes in folding bikes and e-bikes. NYCEWheels was named in the original suit for selling the pedals at its store and online.

"We apologize for any inconvenience we caused due to this case and thank you for understanding," Chen said.
