Specialized Wants Patent Examined

BUFFALO, NY (BRAIN)—Specialized Bicycle Components has requested that the U.S. Patent & Trademark Office (PTO) conduct a reexamination of U.S. Patent No. 7,334,846.

NoTubes.com recently filed a lawsuit against Specialized alleging that certain rims and wheels of Specialized infringe the "'846 patent."

In the likely event that that PTO accepts the request and conducts a reexamination, according to court documents, it will reaffirm the validity of the patent, narrow or reject the claims of the patent, or even invalidate the patent in its entirety.

Specialized recommended the court should stay this patent infringement case in light of the PTO's impending action.

The next court case is scheduled for January 8.
